TERMS AND CONDITIONS
• The Customer agrees and acknowledges that the use of the services offered by LM Tours is at the sole risk of the Customer and that LM Tours disclaims all representations and warranties of any kind, whether express or implied as to condition, suitability, quality, and fitness for any purposes are excluded to the fullest extent permitted by law. Without prejudice to the above, LM Tours makes no representation or warranty that the service will meet your requirements or that the service will be uninterrupted, timely, secure, or error-free.LM Tours shall not be responsible or liable for any direct or indirect loss or damage, howsoever caused or suffered by the Customer arising out of the use of services offered by LM Tours or due to the failure of LM Tours to provide services to the Customer for any reason whatsoever including but not limited to the Customer’s non-compliance with the services’ recorded voice instructions, malfunction, partial or total failure of any network terminal, data processing system, computer Tele-transmission or telecommunications system or other circumstances whether or not beyond the control of LM Tours or any person or any organization involved in the above mentioned systems.Without prejudice to the above, LM Tours shall not be liable for any direct or indirect loss or damage which may be suffered by the Customer as a result of any failure by LM Tours to provide Tour and transportation to the Customer within any stipulated time even if LM Tours has agreed to so provide the service of transport/tour or even if the Customer has advised Quick of the possibility that any such loss or damage would result if the cab is not provided at all or within the stipulated time.

The Customer hereby indemnifies LM Tours from and against and in respect of any or all liabilities, losses, charges and expenses (including legal fees and costs on a full indemnify basis) claims, demands, actions and proceedings which LM Tours may incur or sustain directly or indirectly from or by any reason of or in relation to the use or purposed use of the Services by the Customer and shall pay such sums on demand.

LM Tours shall be entitled at any time without giving any reason or prior notice to terminate the bookings done by the Customer.

LM Tours encourages all its customers to take full responsibility of his/her items. In case of lost items inside the LM Tours cars during the journey, LM Tours will try to locate the items on a “best-effort” basis but is not responsible for the same in case of loss or damage to the same.

If the Customer leaves any goods in any of our cars or has any complaint in respect of the services or the use of the car, the Customer has to inform LM Tours of the same in writing within 24hours of using the services of LM Tours.

LM Tours shall be entitled to add to, vary or amend any or all these terms & conditions and rate at any time and the Customer shall be bound by such addition, variation or amendment once such addition, variation or amendment are incorporated into these terms and conditions at LM Tour’s website at WWW.LMTOURS.CO.ZA in or on the date that LM Tours may indicate that such addition, variation or amendment is to come into effect.

We record all the calls made to our call Centre for quality and training purposes.

All vehicles registered with LM Tours are continuously tracked using GPS for security reasons only.

LM Tours does not warrant that this site, its servers, or e-mail sent from LM Tours are free of viruses or other harmful components. LM Tours will not be liable for any damages of any kind arising from the use of this site, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.

LM Tours shall under no circumstances be liable to the Customer, his or her heirs, dependents or estate for any loss, injury, disability or death arising from the use of the LM Tours services.

The customer shall pay the fare as negotiated with us, After 10 min of waiting at the pickup point & 60mins after arrival time at the airport, a “waiting” fare of R150.00 per hour will be charged. If there are any additional stops on customer’s route and the driver must wait, the R150.00 per hour “waiting” fare will be charged in addition to the normal rate.

Transfers with multiple pick-up or drop-off points will have a surcharge of R100.00 per address depending of the distance or according to our discretion. Contact us for an exact quote.

CANCELLATION POLICY
• No booking will be confirmed without full deposit as per quotation (50% of full balance).
•Cancellation must be advised in writing.
• LM Tours undertakes to protect clients wherever possible from Tours & Accommodation cancellation fees being enforced, however, as a general rule the following conditions apply:

  1. 30 days pride – 0%
  2. 30-15 days -50%
  3. 14-8days – 75%
  4. 7 days lesser – 100%
  5. 20% of total package price is non-refundable 50% deposit required of the quotation for a booking and balance before service.

ALL TRANSFER
And 100% of all transfers price is payable before the service is render and it non-refundable when the driver has been dispatch or Cancellations and Refunds
  1. We have a 24 hour cancellation period and for any transfer not cancelled or changed in writing 24 hours before the reserved time, a full cancellation fee will be charged.
  2. Refunds will be paid as follows:
  •           0 – 1 day prior to departure – No refund will be paid
  •           2 – 5 days prior to departure – a 50% refund will be paid
  •           5 or more days prior to departure – a full refund will be paid

 

  1. All cancellations to be in writing via email to RESERVATION@LMTOURS.CO.ZA or by call to 082 075 0909.
  2. Unforeseen circumstances may delay our service. We request that clients wait 15 minutes after the scheduled collection time and please call us on 082 075 0909 or 072 262 3219 before making alternative arrangements. If your driver is late for your collection by more than 30minutes, you will not be charged for the transfer.
  3. NB: Please ensure that we have a mobile number of the passenger(s) so that we can liaise with them should we be unexpectedly delayed.
  4. As much as we pride ourselves on our reliability and punctuality, unforeseen circumstances may delay or cancel our service without prior notice. LM TOURS, their employers, agents associates and any other person indirectly in the employ or service of LM TOURS not be liable for any loss, damage, injury, accident, death, delay or inconvenience to any person or their belongings. LM TOURS reserves the right to refuse to undertake the conveyance of any passengers.
  5. There will be no refunds or compensation for entertainment or air-conditioning system failure on our shuttle services.
  6. NB: Any changes to your itinerary or route, or any new / extra bookings must be made with LM TOURS and not directly with the driver.
  7. If a passenger fails to join a transfer no refund or rebate will be made.
  8. In the case of a no-show, the full booking fee will be charged, and we reserve the right to take immediate legal action should payment not be received.
  9. We request that you contact us telephonically in case of change in flight plans (diverted, cancelled or indefinitely delayed flights). Please keep our contact number at hand – 082 075 0909 & 072 262 3219.
  10. If a flight is delayed, we will endeavor to monitor the situation and accommodate the change, as we are dependent on information provided to us by (ACSA) Airport Company of South Africa.

However, we will not be held liable for delays caused should ACSA provide us with erroneous information.

CHAUFFEUR/ VIP TRANSFER | LAND DISTANCE TRANSFER
• No booking will be confirm without full deposit as per quotation (50% of full balance).
• No vehicle will leave without full payment before departure commences.
• Full balance to be settled 7 days prior to departure.
• Driver’s meals (3 meals) and separate accommodation are for your account.
• Quotations are valid for 30 days.
• Prices are subject to change without notice.


Luggage

  1. Passengers are allowed to take onto a service one medium sized suitcase or rucksack, and one small item of ‘hand luggage’ with exception of a passenger with a wheelchair (must be conveyed to booking agent at time of booking). We shall have no obligation to carry luggage in excess of the permitted amount.
  2. LM TOURS carries no responsibility for loss or damage to a passenger’s luggage or personal belongings. We recommend that you take out travel insurance from a reputable insurer against all usual and normal risks of loss or damage.
  3. LM TOURS will not be held liable for any incidents whatsoever, to your personal items or luggage.
  4. Advise us if you require more space for baggage than what a normal economy/standard car passenger sedan offers. If necessary, your shuttle can be upgraded to a kombi/minibus.

Health and Safety

  1. The driver has the right to refuse any client who in his/her opinion is a danger to the driver, vehicle or the other passengers.
  2. In the interest of Health and Safety, LM TOURS reserves the right to refuse admission to any of our services where it may hinder the health and safety of fellow passengers.
  3. Smoking and the consumption of alcoholic beverages, or excessive intoxication by use of alcohol or drugs is NOT permitted on our cars services under any circumstances and passengers will be refused boarding at the sole discretion of the driver. In the event of the passenger being refused boarding, the passenger will forfeit any right to a refund or compensation. Note that any open alcoholic beverages are forbidden by law in any vehicle.
  4. You will be held fully responsible for valet and/or repair fees should you / your clients sully or damage our vehicles.
  5. No animals will be carried on LM Tours cars with exception of trained guide dogs accompanying a visually impaired passenger.
  6. LM TOURS is committed to passenger safety. Each vehicle is insured with passenger liability insurance. We only employ drivers that have been issued a Professional Driving Permit (PDP), which is obtained after they pass a medical examination and once a police clearance

certificate has been issued. Our vehicles are maintained to high specification and are inspected daily by management to ensure your safety.

  1. Kindly note that we are bound by the laws set out by the South African Department of Transport. We are issued with road carrier permits annually, which allow us to legally transport passengers. One of the criteria of this permit is that our vehicles are never under any circumstances allowed to exceed a speed of 100km/hr. Furthermore, we would love to maintain the safety of our passengers, thus we ask for your patience and understanding in this regard. Bearing this in mind, kindly ensure that you allow sufficient time to reach your destination.

All information on LM Shuttle & Tours website is subject to change and we reserve the right to correct any mistakes that may appear on our website. These general booking conditions are subject to change and we reserve the right to update these conditions without notice.

LM Shuttle & Tours does not capture and store any personal information about individuals who access this Web site, except where you voluntarily choose to give us your personal details via email, or by using an electronic form, or enquiring about any of our services. In these latter cases, the personal data you submit to LM Shuttle & Tours  will be used exclusively for providing you with the information you have requested. In order to provide you with a particular product or service online, we may request that you voluntarily supply us with personal information, including your E-mail address, for purposes such as correspondence.

We may use information you have given in the following manner, provide a service, measure consumer interest in our various services and inform you about products and services. We may send you E-mail offers, If you provide us with your E-mail address, or have done so in the past, and if we obtain your E-mail address from another source. These offers may be based on information you provided in your initial transaction with us. These E-mail offers come directly from LM Shuttle & Tours .

Declining E-mail Offers:

LM Shuttle & Tours  provides customers with an easy means to decline/unsubscribe from receiving E-mail offers. Although most customers tell us they appreciate the offers we send them, we recognize the importance of providing you with a choice. Each E-Mail offer we send includes an opportunity at the bottom of the E-Mail to unsubscribe from this service. If you have received an E-Mail and do not want to receive in the future, just click the “Unsubscribe” link provided and send the E-Mail message generated. You will be automatically unsubscribed from our system. Please note: This process may take up to 24 hours to remove you from our mailing lists. We apologies for any inconvenience this may cause.

Children/Minors:

We do not use www.lmtours.co.za to knowingly solicit data from or market to persons under the age of majority.

INDEMNIFICATION AND EXCLUSION OF LIABILITY
• The client accepts that the tour is of an adventurous nature and involves an element of personal risk.
• The Company and its respective directors, officers, employees, representatives and agents shall not be liable for any loss or damage of whatsoever nature and howsoever arising ( including, but not limited to, the client’s or any other person’s injury or death, or any loss of or damage to the client’s or any other person’s property) which the client or any such other person may incur or suffer as a result of or arising from the clients participation in the tour and any other activities undertaken on or during the tour, and the client irrevocably and forever releases and discharges the Company and its respective directors, officers, employees, representatives and agents from any and all such liability.
• The client furthermore indemnifies and holds the Company and its respective directors, offices, employees, representatives and agents harmless from and against any land all loss, damage, actions, proceedings, claims, demands and legal and other costs and expenses (including legal costs on an attorney and own client scale) of whatsoever nature and howsoever arising (including, but not limited to, the client’s or any other person’s injury or death, or any loss of or damage to the client’s or any other person’s property) which the client or any such other person may incur or suffer as a result of or arising from the clients participation in the tour and any other activities undertaken on or during the tour.

TERMS OF PAYMENT

We accept all major credit cards: Visa, MasterCard .

If you prefer to pay for your booking with a bank transfer, please contact us here and send us all the information regarding the booking, name of the tour, type of car, Transfers information, accommodation and arrival date.
There is no service fee for processing Visa or MasterCard payments.
All Prices quoted on LM Shuttle & Tours are in Euros (ZAR) and per person, unless otherwise specified. All payments and refunds are due in Rands. LM Shuttle & Tours is not responsible for any changes in currency exchange rates that might occur from the time of booking until a refund is made.

• Your purchase does not automatically guarantee a reservation. Your purchase will be confirmed via email within one to two business days. The cancellation fee policy will take effect once you submit your reservation. If your purchase cannot be confirmed for any reason, we will fully refund your purchase without any additional charges. We recommend each customer read and review the cancellation policy and consider purchasing a Travel Insurance policy.

What CAN be Refunded:

• Some tours may require a minimum number of travelers to operate. The affected traveler will be fully refunded or may choose a similar tour product as a substitute. Should this occur, it would be under very rare circumstances because we try our best to accommodate travelers.

• Please note that the product substitute chosen by the traveler may be more expensive than the original product and therefore may be subject to an additional cost.
• Any additional refunds based on extenuating circumstances will depend on the individual tour operator.

 

What CANNOT be Refunded:

• All hotel and tour schedules are arranged ahead of time. Any person failing to appear on the day of departure will not be refunded.

• No refund will be given for any portions of the tour unused by the traveler after tour departure regardless of circumstances.
• Airfare is completely non-refundable and non-changeable for tours when airfare is included in the final price.
• Hotel extensions and Instant Confirmation products (admission tickets, city passes, etc.) cannot be exchanged or refunded once confirmed.

Our Cancellation Policy

The Cancellation Policies listed below apply to all reservations unless the tour booked has specific rates or fees listed under “Special Notes.” Please carefully review the “Special Notes” of your tour prior to booking. Please know that LM Shuttle & Tours will always adhere to individual tour policies when applicable.
Refund Policy

Non-refundable
50% of payment is refunded
75% of payment is refunded
90% of payment is refunded

• Please note that cancellation fees are calculated based on the date we receive your signed Cancellation Request Form and travel service start date.
• If a tour is scheduled to depart within the next 7 days, we will not change a traveler’s departure date and will not offer a refund.
• All cancellations must be made directly with LM Shuttle & Tours, not with tour providers.
• In most cases, reservations paid by wire transfer, cash deposit, or money order/traveler’s check/cashier’s check will be refunded via PayPal or check. For refunds processed by wire transfer, any associated wire transfer fee will be deducted from the overall refund amount.

How to Cancel a Reservation

 

We will process your cancellation/refund request within one to seven business days. We will NOT acknowledge any verbal / over-the-phone request or voice mail. Verbally speaking with our customer service representatives without filling out a request form will not guarantee that your cancellation has been processed or acknowledged. We will NOT accept email cancellations unless they have a complete, signed, and attached Cancellation Request Form.
• Cancellation must be made by filling out and signing the LM Shuttle & Tours Cancellation Request Form. Please explain why you are requesting a cancellation. Please download Cancellation Request Form here.
• Customers may print out the LM Shuttle & Tours Cancellation Request Form and send it to LM Shuttle & Tours by fax or mail.
• Customers may also email a scanned/digital Cancellation Request Form with your electronic signature.

Amendment Fees:

Any changes made to a reservation after successfully submitting the order online will be subject to a minimum ZAR150.00 Amendment Fee (per change). Reservations will be confirmed within one to two business days. The following constitute as an amendment to a tour:

• Changing departure date
• Changing pick up time or location
• Changing tour
• Changing guest name
• Changing itinerary
• Removing / Replacing a guest
• Adding / Replacing a guest
• The ZAR150.00 amendment fee is a minimum tour change fee. If you request multiple changes and/or request the adjustments at the last minute, additional fees may apply (in addition to the ZAR150.00 amendment fee). Paying the ZAR150.00 amendment fee does not guarantee a change can or will be made.
